AE Light wins lawsuit against Undewater Lights, LLC / Seavision of Ft. Lauderdale Floria

After a five year court battle AE Light prevailed over Underwater Lights USA, LLC. The lawsuit was filed in early 2009 when Underwater Lights USA, LLC (UWL) refused to pay for ballasts they ordered for use in their light fixtures. In a countersuit filed against AE Light (Plaintiff) by UWL, (Defendant) UWL claimed the ballasts were defective. Court documents show UWL continued to order ballasts even though they claimed defects. AE Light was able to prove and quantify through independent testing the ballasts were not defective and held up to even the most adverse conditions.

In the judges decison he stated, "There are two issues presented here that Defendant contends excuses their failure to pay the invoices, and the Court will address both. First were the ballasts and igniters in fact defective by design or manufacturer. If they were, Defendant failed to carry the burden of proof on this.... The problem though is that the Court cannot conclude it was the result of design or manufacture, as opposed to improper installation of customer negligence (water intrusion). The expert testimony on the issue offered by the parties was equally persuasive. The Court cannot conclude therefore that the malfunction was a design or manufacture defect such that the warranty issue would even arise.

Even if the Court had determined that the light failure was Plaintiff's fault, or Plaintiff's manufacturer, the Court cannot conclude Defendant ever made a timely rejection of the product included in these invoices, or for that matter any rejection at all of the subject product. To the contrary Defendant continued ordering more product from Plaintiff. It was Plaintiff that finally terminated the relationship with Defendant and that was only after it became clear Defendant was continually delaying payment".

The judge went on to state, "Defendant also asserts a right counterclaim bases on breach of warranty. Defendant alleges damages of $63,748 as a result of the alleged breach. The Court stated above that Defendant did not carry the burden of proof on the breach of warranty and therefore the counterclaim is dismissed and Defendant is not entitled to damages for breach of warranty. Plaintiff is the prevailing party on its first claim for relief for account stated and is entitled to judgment.... together with interest...... and resonable attorney fees. All other claims and dismissed".

Even after the final judgement in January of 2013, Underwater Lights, USA, LLC dba Seavision continued to fight the judgement and draw the lawsuit out. Knowing that they (UWL) would have to pay substantial legal fees for not only their lawyers but those of the plaintiff they finally agreed to settle thus avoiding the judgement being listed on their credit report.

Grants Pass, OR – February 18, 2013 – AE Light just introduced a new weapon light. 
 
The AEWL2 weapon light is powered by U.S.A. made Cree Q5 LED producing 200 lumens with 1-CR2 Lithium battery for 40 minutes. The AEWL2 is one of the smallest Weapon Lights in its class. This mini sized pistol light is designed to mount on standard gun rails. Rotating the barrel facilitates use by either left or right-handed users. The push button switch is activated by your index finger for momentary or steady on.  The LED is mated to a polished and plated reflector to produce a clean spot beam for maximum illumination of your target.
 
AEWL2 produces 2150 LUX @ 3ft (1M) – 245 LUX @ 9ft (3M) with a peak beam intensity of 2205cd.  It has a clear beam distance of 300ft (94M), and a rating of IPX-8 (waterproof up to 3ft. (1M).  Made of aircraft grade aluminum, with mil-spec black anodize coating it is impact resistant to 36in (1M), and comes with a 2-year warranty.
